Land affected by the Amendment
The Amendment applies to the following land:
- Eastern end of John Street, Eltham
- Eastern end of Bridge Street, Eltham
What the amendment does
The Amendment proposes to:
- Partially rezone the eastern end of John Street, Eltham from Neighbourhood Residential Zone Schedule 1 (NRZ1) to Public Park and Recreation Zone (PPRZ).
- Partially rezone the eastern end of Bridge Street, Eltham from Neighbourhood Residential Zone Schedule 1 (NRZ1) to Public Park and Recreation Zone (PPRZ).
The Amendment
Why is the Amendment required?
The amendment is required to implement the findings of a review of this Council managed land that is currently serving a public open space function, but not appropriately zoned. The review found that these sections of road reserve were no longer required for the purpose of vehicular use, Council is in the process to discontinue these two road reserves pursuant to the statutory process under the Local Government Act 1989 and retain the resultant land for public park and recreation, including pedestrian access.

Making a submission
Any person who may be affected by the amendment may make a submission to the planning authority (Nillumbik Shire Council).
The closing date for submissions is Monday 18 February 2021.A submission should be posted to:

A submission which seeks to change the amendment and is not accepted by the planning authority will be referred to an Independent Panel appointed by the Minister under Part 8 of the Planning and Environment Act 1987.
If a submission is referred to a Panel, a Directions Hearing is likely to be held in the week commencing 26 April 2021 and the Panel hearing in the week commencing 24 May 2021.
Anyone who has made a submission which has been referred to a Panel has an opportunity to be heard.
In accordance with State legislation, a copy of every submission, redacted to remove a submitter’s personal information, will be available on this website (i.e. Participate Nillumbik) for any person to inspect free of charge for two months after the amendment comes into operation or lapses.
